ID-IGF 2016: Balancing Human Rights and Cybersecurity Policy in Indonesia

Selasa, 15 Nov 2016

ELSAM, Jakarta – Post declaration of Indonesia Internet Governance Forum (ID-IGF) in 2012, the forum (ID-IGF) was again held for the fourth times on Tuesday, 15 November 2016. It was held in BPPT building, Jakarta, taking the theme of “Realizing Digital Sovereignty and Independence in Indonesia” and engaged with many stakeholders to regulate the democratic internet governance.

In Indonesia Internet Governance Forum this year, ELSAM took part in one workshop for the category of law related to the development of cybersecurity policy. The workshop entitled “Integrating human rights to the institutionalization of Cybersecurity Policy: An Offer to Indonesia” presented the following resource persons, namely, Edmon Makarim from Law Faculty of Universitas Indonesia, Arwin D. W. Sumari from Cyber Resilience Desk of Coordinating Ministry of Law, Politic and Security (Kemenkopolhukam) as the representative from government, Ardi Sutedja from Indonesian Cybersecurity Forum (ICSF) as the representative from business sector, and Wahyudi Djafar from ELSAM. The workshop discussed a lot more the offer of development of cybersecurity policy which has human rights perspective in Indonesia, considering that Indonesia has not had the exact definition on national resilience.

According to Arwin Sumari, Indonesia is both vulnerable and risking of cyber-attacks so that it will need protection mechanism including national issue integrated in cyber world. Similarly, Edmon Makarim stated that access security is also included in the important point in the discussion of human rights and internet. According to him, Indonesia recently is in void in terms of cyberspace protection between the institution of defense and security, because there is no national resilience concept with exact definition. “It needs one institution to become the pivot of coordination derived from multi stakeholders. It targets at answering the constitution needs which involves the model of information resilience protection”, he added.

In the context of cyber policy institutionalization, according to Wahyudi Djafar, it needs one model of protection which is pursuant to human rights respect. One of the realizations in to guarantee the rights to be safe for the internet users and citizens. Moreover, safety must also guarantee the freedom of expression and right to information through cyber world for the internet users.

“We have to learn from Estonia which had undergone cyber attack causing a collapsed situation even in its economy aspect. From the disaster, Estonia succeeded to build a strong cyber infrastructure. Not only does the policy protect the national and economy concerns, but it also enables internet to be infrastructure which opens free space for the society to express in internet,” Wahyudi explained.

To do so, it needs a comprehensive evaluation at the policy and institutional level as well as the threats. This also includes the internalization and integration of human rights values in formulating the policy starting from the structure, process and result. One step offered by ELSAM is to formulate a white book and road map of policy and strategy of national cybersecurity. Improvement of legal architecture with the policy and regulation changes, and also institutional reposition and strengthening of the social architecture including public awareness and digital culture. This aims at creating a cybersecurity policy which can give protection heterogenically and comprehensively to all elements of society including minority groups.
